No court-martial for marine in shooting

No Court-Martial in Iraq Mosque Shooting

SAN DIEGO - A Marine corporal who was videotaped shooting an apparently injured and unarmed Iraqi in a Fallujah mosque last year will not face a court-martial, the Marine Corps announced Wednesday.

 

A review of the evidence showed the Marine's actions were "consistent with the established rules of engagement and the law of armed conflict," Maj. Gen. Richard F. Natonski, commanding general of the 1st Marine Division, said in a statement.

 

The corporal was not identified in the two-page statement issued by Camp Pendleton, the headquarters of the expeditionary force north of San Diego.

 

In sworn statements, the corporal said he shot three insurgents in self-defense in the mosque Nov. 13, believing they posed a threat to him and his fellow Marines, the statement said. Autopsy results showed that all three died of multiple wounds from gunshots fired from the corporal's M-16.

 

One of the shootings was recorded by Kevin Sites, an NBC cameraman embedded with the Marines, and the dramatic footage prompted outrage among Iraqis and an immediate investigation by the Marine Corps.

 

In the video, as the cameraman moved into the mosque, a Marine in the background could be heard shouting obscenities and yelling that one of the men was only pretending to be dead. The Marine then raised his rifle toward an Iraqi lying on the floor of the mosque and shot him.

 

The incident played out as the division's 3rd Battalion, 1st Regiment, returned to the unidentified Fallujah mosque. While Marines had secured the mosque complex on the previous day, intelligence reports indicated that the mosque had since been reoccupied by insurgents.

 

The Camp Pendleton statement said the corporal "could have reasonably believed that the AIF (anti-Iraq forces) shown in the videotape posed a hostile threat justifying his use of deadly force."

 

Before the opening of the Nov. 8 assault on rebel-held Fallujah, Marine commanders told infantrymen that the rules of engagement allowed the use of deadly force against men of military age deemed holding hostile intent, even if the enemy didn't fire on the Marines first.

 

According to the Marine Corps, an enhanced videotape of the shooting supports the corporal's claim that the wounded Iraqi was concealing his left arm behind his head. Although the Marines said it was unclear from the video whether the Iraqi made any overtly threatening gestures, enemy forces commonly feigned death.

 

The investigation consisted of 22 interviews with Marines, autopsy reports, ballistic tests and the videotape of the shooting. The Marine was brought back from Iraq following the shooting. He remains at Camp Pendleton, said Lt. Col. T.V. Johnson, a Marine spokesman.

 

A fourth Iraqi also was shot and killed in the mosque complex, but the bullets could not be traced to the corporal's weapon, according to the statement. The investigation is ongoing into the death of the fourth insurgent, Johnson said.

Sad that this was even an issue.

Sad that "embedded reporters" have caused the death of so many sevicemen attempting to be "PC" in the eyes of the media.

A close family friend (20 years old ) is on his way over as I type, I told him to shoot the media first and anything not coalition next!!  Better to be juged by 12 than buried by 6.

Your'e forgetting something Foosh , that chick didnt do anything wrong , Ive been in Prisons for many years and what goes on in there is a nightmare compared to the silly shit in Iraq! She didnt do anything , the day before (as people so easily forget) some of these same Iraquis were killing Americans ,They are lucky the Americans caught them instead of the Polish troops , they'd be dead right now it the Poles had got them!

 

What I find odd , is the coverup that no one seems to mention! This girl is what a non-commissioned Officer correct , usually in any job that Ive ever held Shit rolls down hill , and that means the shit comes from the top! In this case the Army has even acknowledged that the female General in charge was negligent , but they her retire (at full pay) , well , what the the full bird Colonel, Lt.Col,Major,Captain,Lt ,SgtMaj? I dont see any of these people being ostrasized by the public? They were in charge ? I also dont see the CIA or DIA ,or Army Intel having any involvement in this when clearly the interrogations were performed by Intel Agencies?

 

Bottom line is this whole this a farce ! Did you see the insurgents prisons on how they treated Americans? Remember the little White girl and the little Black girl that were beaten to a pulp , the Iraquis tortured these women , breaking and smashing bones, and Foosh this was way before the bullshit prison incident so dont blame backlash on this!

 

The Iraquis treated our troops who were captured with DEATH & TORTURE . Not humilating the prisoners by being nakid or on a leash , that POS is alive today , we have Americans dead not because of this prison incident , but because we allow the international community to dictate whats right and wrong ! We are the highest example the world has ever known when in comes to right and wrong!

I agree.  The only problem I have is...what the fuck...Don't document it with pictures...it should be like Vegas, what happens there stays there.  The only way two people can keep a secret is if one of them is dead.

Judge would not accept her guilty plea. Rules are not the same in military courts. If the judge thinks you really did not know what you were doing was wrong the judge can not accept a guilty plea.

This just in: The General has been demoted to Colonel , basically that means she's retired , the bad news is she can still apply for her General pay in retirement (depending on how long she was a General , usually three is sufficent!

 

It also says a Colonel , 3 bottle cap Colonels , majors ,captains etc were given punishment , really doesnt mean shit , the enlisted guys were given criminal convictions , slapping the commanding Officers wrists!

 

No Intel Officer or Agent was even interviewed , except the General in charge and she was exonerated!

STOP taking prisoners. During the D-Day invasion of Normandy, the Allied forces took no prisoners for the first ten days. The logistics of keeping them out of trouble simply posed too great a risk to our military forces. These barbarians give no quarter, so neither should we. The Romans knew this. They killed everyone who disagreed with them. Amazing how easy it was for them (the Romans) to reach a concensus.
