Bittersweet Weekend

It was great to finally order my vintage... can't wait to take delivery in a week or so...

 

On the downside... today is the 2 year anniversary of our house burning down.... we are having very slow contractor issues and are not in our house yet... still live in a damn camper.... They tore the remains of the structure down in March of 2013... after waiting on insurance, selecting the contractor and designing the replacement....according to the bank he is 52% complete on the house as of last week... he hasn't done jack since then... one guy here... rough in inspections completed last week... my construction loan expires on May 29th... not sure how we'll proceed... will be talking to loan officer this week to weigh our options...

 

I'll never camp again....

Wow! 2 years? Incredible! Did you have some delay with you insurance company?

hope he gets a fire in his ass to get it done....if he was living in a fucking camper I am sure he would be a little more anxious to get it completed and make you and the wife happy campers (no pun intended).

That sucks Stu. Is it possible to look into another contractor? Are you locked into this one?

damn sorry ass contractor.

Should probably TAZE his ass and,

tell em he's due about a dozen more tazings

till he gets ya to the move in part of the construction..

I have a lot of stuff we purchased for the house in his warehouse... makes it tougher to fire him... not impossible but tougher.... I don't know what our options are yet... I'll know next week... there was about a 6 month delay to get insurance money.... then to design based on what we got, select the contractor and secure a loan...... so we were almost 10 months to break ground... he is 14 months into a 6 - 8 month build..... by his timeline....

Congrats on the new Indian on order. On the other hand, the contractor is acting like he got paid in advance. Tough situation. I hope there is a way to get the project moving like it should be.

same happened to my sister on new years day 2014 got out with only the cloth on there back, 250 year old salt box an a life time of antics , shes been bumping heads with the insurance co good thing the gun was in the house :no:

Ya know----

 

I hate to see a friend in need. You can always bring that red Vintage over and park it in my garage till your garage is done.

I will even break it in for you.

 

You get the added bonus of knowing your bike kicked Indian Lover's car out of the garage.

Sounds like ya shoulda vetted your contractor better. Is he overpaid at this point of completion? Did you withhold the normal 10% of each pay application? Sounds like he is working on other projects where he can get paid. How long will it take him to get to another percentage of completion to draw more money from you.

 

First rule of owners in construction: Don't pay up front and don't overpay on percentage of completion. Always stay ahead of the contractor.

I chose him because of the guys pounding the nails that worked for him, and his background in insurance restoration.... Two guys that worked for him did my garage and sunroom before the fire... they don't work for him any more.... I really think we are more than 52% complete and he is less than 50% paid... I'm talking to the bank today to see what my options are.... I'll give you a call... I'd like to know what he could do if I say I've had enough... our contract says 6 - 8 months to complete... he's blown that out of the water....

And just to add to the bittersweet weekend.. I got the 02 out and for a ride... then a bud came and took it for a ride... he'll probably be buying it... but maybe not... but it could be gone.. sad.... it's the mostest favoritest scoot I've ever had the pain and pleasure of riding and wrenching....

Our contracts give us the right to terminate for cause, hire the work completed, and back charge the original contractor with whatever it costs. Of course, if he ain't got anything, it's a moot point, unless he is bonded. Then the bonding company is on the hook for the balance to completion. Not completing a project usually is the death penalty for any contractor though. He should want to get done if he plans on staying in the business.

 

I'm speaking as a contractor dealing with subcontractors here, but our contract with the owners reads the same on their behalf.

I was good on my recovery until John Smith (Warlord) showed me a picture in Australia of a 48 Chief in Indian Red with white walls next to another red Indian Chief with white walls. I soon realized the other bike was my REDHOTBITCH but with whitewalls but looking just as shiny and sweet as the day she got on the boat for the ride Down Under. I miss that bike....

Stu - have a good look at the contract. With residential building contracts, there might be one or two steps you have to take before you can terminate. If you can find a clear default under the contract, then you probably have to give him written notice to 'cure' the default. Then if he doesn't, you can fire his ass.
