She has filed a claim with my insurance agency. She says the accident has caused her low back pain. Since the bike did not hit her car...I did....I guess my head is SO damn hard, it transmitted all that kinetic energy into her bumper, through the car, and right into her lower back. At least she had insurance don't know what that state requires you to have she probably carries the minimal. The drunk SOB that hit my son only carried the basic which ain't shit. That SOB done had 4 DWI convictions and he was still driving had a 4 pages of convictions and he still drove. People that you would think had higher morals lose their morals the second your vehicle touches the rearend of theirs. Most companies are getting tougher on these "soft tissue" injuries, but the fact remains that it is most times still cheaper to pay a few thousand and not have to drag it out and possibly go to court and have a jury "punish" the insurance company. Sting Posted May 23, 2012 Share Posted May 23, 2012 Mark, once your insurance turns it over to an atty. to represent you, I would ask them if a counter-suit would work to shake her tree. I've had to do that a few times in my business and it works, if it's a no brainer like this one. I fired a supervisor that worked for me once, her atty threatened to file suit unless I paid her $54k for losses, my atty countered and told them to drop it or we would file suit for all of his fees ($335/hr), my time, and whatever else we could add on. It worked. They knew they didn't have a case ( I was justified for firing her), and at least here in Ohio, I could counter for the frivolous claim. It works! See if in your state (or her's) if you can counter for suits. If you can, do it. The last thing you want to do is settle, but it's probably up to the insurance company to make that call, not you. Or sues for $150,000 + $50,000 expenses --- so your insurance pays the 50k before the po white trailer trashes old man comes to court asking for another 50k cause she can go (DOWN) due to neck injury (alienation of affection) Least thats how its done in Californication.
