The civil suit coming up depends a great deal on the criminal conviction of the perpetrator. The judge is protecting the city's bottom line. If the perp were not employed by the city, he would have the max penalty - jail time, fines, banning from having a driver's license, etc. All revenues to the government and screw the citizenry to the max... How secure can you feel when the 'Serve & Protect' sqad does neither and gets away with MURDER as a matter of course??? I am suprised they ever took a blood sample from the bastard drunk f_ckhead in the first place and Yes the State Police, Troopers or Highway Patrol should step in automatically and take over any Fatal traffic accident - especially when an officer is to blame or involved in the least bit. And if he's an elected judge - he ought to be toast. From what I have heard this is how I understand it... Basically, the technicality is when a cop is drug or alcohol tested for an on the job injury or random test(if they even have them) they go to a type of "occupational health clinic" or something similar. If they are involved in a criminal investigation that requires testing, they are supposed to be taken to an actual hospital and the person conducting the test has to be certified with the state.
